Shipping and Delivery

We aim to process and ship orders within 3-5 business days. Delivery times vary based on location and shipping method selected. We are not responsible for delays caused by shipping carriers, weather conditions, customs clearance, or other factors beyond our control.

Returns and Refunds

We offer returns and refunds on eligible products within 7 days of delivery, subject to our Return Policy. Products must be unused, in original packaging, and in resalable condition. Perishable goods, customized products, and opened items may not be eligible for return.

Effect of Termination

Upon termination of these Terms:

All rights granted to you under these Terms will immediately cease
You must immediately cease all use of our Services
Any outstanding payments will become immediately due
Provisions that by their nature should survive termination will remain in effect

These Terms and your use of our Services shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. The United Nations Convention on Contracts for the International Sale of Goods shall not apply.

Jurisdiction

Any legal action or proceeding arising under these Terms will be brought exclusively in the courts located in Purba Bardhaman, West Bengal, India, and you hereby consent to the personal jurisdiction of such courts. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.

11. Dispute Resolution

We prefer to resolve disputes amicably and efficiently. Before initiating any formal legal proceeding, you agree to first contact us at legal@samiunagromarine.com to attempt to resolve the dispute informally.

Negotiation

Parties will attempt to resolve disputes through good faith negotiation for at least 30 days

Mediation

If negotiation fails, parties may pursue mediation before initiating litigation

Arbitration

Any dispute, controversy, or claim arising out of or relating to these Terms, or the breach, termination, or invalidity thereof, shall be finally settled by arbitration in accordance with the Arbitration and Conciliation Act, 1996. The seat of arbitration shall be Purba Bardhaman, West Bengal. The arbitration shall be conducted in the English language. The arbitral award shall be final and binding upon both parties.

12. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

Continued Use

By continuing to access or use our Services after any revisions become effective, you agree to be bound by the revised Terms. If you do not agree to the new Terms, you must stop using our Services.
